Client Responsibilities
To help us complete your project effectively, you agree to provide accurate information, instructions, reference materials, and other content reasonably required to perform the services.
You are responsible for ensuring that any materials you provide to us do not knowingly violate the rights of another person or organization.
Delays caused by missing information, late feedback, or failure to provide required materials may affect the agreed project timeline.
Project Scope and Changes
Services are performed according to the agreed project scope.
Requests that substantially change the original requirements, add new services, or require significant additional work may result in additional charges and an adjusted delivery timeline.
Any additional work will be communicated to you before it is undertaken whenever reasonably possible.
Payments and Fees
All service fees will be communicated before the relevant project or service begins.
Depending on the project, we may require a deposit, milestone payment, full payment, or another agreed payment arrangement.
Payments must be made according to the agreed schedule. We reserve the right to pause work or withhold delivery of completed materials when required payments are overdue.
Third-party costs, including publishing, printing, distribution, advertising, platform, or other external charges, may be separate from our service fees unless specifically included in your agreement.
Revisions and Approvals
Where revisions are included in a service package, they will be limited to the number and scope specified in your project agreement.
Clients are responsible for reviewing and approving deliverables within a reasonable period. Once a deliverable has been approved, additional changes may be treated as new work and may incur additional charges.
Ghostwriting Services
Ghostwriting services are provided according to the agreed project brief, writing requirements, and contractual terms.
The ownership, usage, attribution, and rights associated with completed ghostwritten material will be determined by the applicable project agreement.
Clients are responsible for providing accurate information and instructions necessary for the ghostwriting project.
Editing and Proofreading
Editing and proofreading are intended to improve the quality, clarity, consistency, grammar, spelling, and presentation of submitted content.
While we make reasonable efforts to identify and correct errors, we do not guarantee that every possible error will be identified.
The client remains responsible for reviewing and approving the final manuscript.
Book Design, Formatting, and Typesetting
Book design, formatting, typesetting, and layout services are delivered according to the agreed specifications.
Final results may vary between publishing platforms, file formats, devices, printers, and distribution services.
We are not responsible for technical changes or formatting requirements imposed by third-party publishing or distribution platforms after delivery.
Publishing Services
Where publishing assistance is provided, we may assist with preparing and submitting materials to third-party publishing or distribution platforms.
Acceptance, approval, pricing, distribution, availability, royalties, and other decisions made by third-party platforms are outside our control.
We do not guarantee that a book will be accepted, approved, ranked, distributed, or sold by any third-party publishing platform.
Book Marketing
Marketing services may include promotional strategy, advertising support, campaign management, content creation, or other agreed activities.
Marketing results can depend on numerous external factors, including market conditions, audience response, advertising platforms, competition, budget, and the quality of the underlying product.
Therefore, we do not guarantee specific sales, rankings, revenue, reviews, downloads, or audience growth unless expressly stated in a written agreement.
Audiobook Services
Audiobook services may include narration, production, editing, mastering, and preparation of audio files, depending on the selected service.
Delivery specifications may vary depending on the requirements of the intended publishing or distribution platform.
Third-party platform approval or distribution is not guaranteed.
Intellectual Property
Unless otherwise agreed in writing, all intellectual property rights belonging to Peng Oak Publishing, including our website, branding, logos, original service materials, templates, processes, and other proprietary content, remain our property.
You retain ownership of original materials that you provide to us, subject to any rights or licenses required to perform the agreed services.
Ownership or licensing of final project deliverables will be determined by the applicable service agreement and payment terms.
Client Content
By providing content, manuscripts, images, logos, or other materials to us, you confirm that you have the necessary rights, permissions, or authorization to use and provide those materials.
You agree not to provide materials that knowingly infringe copyright, trademark, privacy, publicity, or other legal rights.
You remain responsible for the legality and ownership of materials you provide.
Confidentiality
We understand that clients may provide unpublished manuscripts, book concepts, business information, and other confidential materials.
We will use such information only as reasonably necessary to provide the agreed services, subject to applicable law and any separate confidentiality or Non-Disclosure Agreement.
Third-Party Services
Certain services may involve third-party platforms, software, publishers, distributors, payment providers, advertising platforms, hosting providers, or other external services.
We do not control these third parties and are not responsible for their policies, availability, security, decisions, fees, technical requirements, or changes to their services.
Refunds and Cancellations
Refund eligibility depends on the nature and stage of the project and any refund terms agreed upon before work begins.
Because many of our services involve customized work performed specifically for a client, completed work, work already in progress, or non-refundable third-party costs may not be eligible for a refund.
Any cancellation or refund request should be submitted to us as soon as possible.
Limitation of Liability
To the maximum extent permitted by applicable law, Peng Oak Publishing will not be liable for indirect, incidental, consequential, or special losses arising from the use of our website or services.
